Arbitration and Mediation

Allyn & Fortuna’s attorneys are accomplished trial attorneys with a reputation for thorough preparation and aggressive advocacy. Although we enjoy an impressive record of courtroom achievements, our lawyers seek to optimize case outcomes while managing the costs, time and stress of a lawsuit on our clients. This enables our clients a range of options in litigating disputes from confidently going to trial, reaching a favorable settlement during trial or seeking alternate dispute resolution (ADR) resources like arbitration or mediation.

In mediation, the mediator, acting as a neutral, helps parties try to reach a mutually acceptable resolution to their dispute. The mediator does not decide the case but facilitates the discussions. In arbitration, the arbitrator renders a binding decision. Arbitration is a private and less costly alternative to the more formal nature of court proceedings. Resolving a legal dispute through ADR avoids the expense, publicity and delay of a trial. It is almost always faster in reaching a conclusion and there are limited grounds for appeal.

Our lawyers evaluate the most appropriate and effective strategies to reach clients’ goals and, in doing so, routinely use arbitration, mediation and other forms of ADR as pragmatic ways to meet our clients’ needs. Allyn & Fortuna has experience in using mediation and arbitration to successfully resolve disputes for our clients, ranging from large corporate matters to straight forward two-party conflicts. Our attorneys also counsel clients on how to incorporate ADR into their everyday business practices. We analyze issues, draft mediation and arbitration clauses in all types of agreements ranging from commercial contracts, consumer agreements, and employment agreements to settlement agreements. We develop strategies to resolve complex disputes, such as those involving multiple claims, multiple parties, multiple jurisdictions and parallel or closely-related arbitral and judicial proceedings. Additionally, Allyn & Fortuna has successfully enforced arbitration provisions on behalf of our clients in state, federal and appellate courts.
